Abstract
يتناول هذا البحث تعريف اللاجئين وحالهم، لا سيما مع الوضع الحالي الذي زادت فيه الحروب على مستوى العالم؛ مما ساعد على تكاثرهم، وأغلبهم مسلمون يعانون الفقر وضيق الحال، وأوضاعهم تزداد سوءًا إذا تمكنوا من العودة إلى أوطانهم، أو استقروا في بلد الملجأ. فما حكم تخصيص مال الزكاة لهم وإخراجها من بلد إلى آخر، وأي سهم من أسهم الزكاة يخصص لهم في حال جوازها. المنهج المتبع في هذا البحث المنهج الوصفي القائم على المناهج الفرعية الآتية: الاستقرائي التحليلي، وذلك باستقراء حالة اللاجئين وبيان حكم الزكاة عليهم في ضوء المعطيات، وبيان الحكم من خلال استعراض آراء العلماء والفقهاء، والوقوف على أدلتهم، والمناقشة والترجيح، وقد اشتمل البحث على مقدمة ومبحثين، كان المبحث الأول: في تعريف اللجوء وحكمه والألفاظ ذات الصلة، والمبحث الثاني: هو صلب الموضوع، والحديث فيه عن موقف الإسلام من إخراج الزكاة للاجئين. وتوصل البحث إلى مجموعة من النتائج، أهمها: أن اللجوء مشكلة قديمة معاصرة، ليست وليدة العصر، لكنها ازدادت سوءًا في الوقت الحاضر، وكان طابع الإسلام هو السائد على هؤلاء اللاجئين، فيتردد الكثير من الناس في دفع الزكاة إليهم. وقد حاولت الباحثة التوضيح بأنهم لا يخرجون عن صنفين من أصناف الزكاة: إما أن يكونوا فقراء، وإما أن يكونوا من أبناء سبيل. الكلمات الدالة: اللاجئ، الزكاة، ابن السبيل، الفقراء والمساكين. Abstract: This research paper deals with the definition of refugees and their situation especially with the current situation in which wars have increased worldwide. This produced more refugees, most of which are Muslims that suffer from poverty and distress and their conditions will worsen if they go back to their homelands or settle in the country of refuge. What is the provision of allocating zakat money to them and taking it out from one country to another? Which zakat share is allocated to them if it is permissible? The approach followed in this study is the inductive and analytical approach, by examining the situation of refugees and clarifying the provision of zakat for them in the light of the given data and through reviewing the opinions of scholars, commenting on their evidence, discussion and preponderating. The research paper includes an introduction and two sections. The first section is the definition of asylum and its provision and related terms, and the second section is the core of the topic, and it is about the position of Islam regarding the payment of zakat for refugees. The study reached a set of results, the most important of which are: asylum is an old, contemporary problem, but it has worsened at the present time, and most of such refugees are Muslims, and people are hesitated to pay zakat to them. The researcher tries to clarify that they are of two types of zakat categories, either they are poor or wayfarers. Keywords: refugee, zakat, wayfarer, the poor and needy.
